브레이크뉴스 정명훈 기자= 이재명 더불어민주당 대표의 정치 명운을 가를 공직선거법 위반 혐의 항소심 재판부는 26일 공소사실 모두 허위사실 공표로 인정되지 않는다며 무죄를 선고했다. 

서울고법 형사6-2부(부장판사 최은정·이예슬·정재오)는 이날 오후 2시경부터 공직선거법 위반 혐의로 기소된 이 대표의 항소심 선고공판에서 1심 판결을 파기하고 무죄를 선고했다.

앞서 이재명 대표는 '고(故) 김문기 전 성남도시개발공사 개발1처장을 몰랐다'는 발언을 한 것과 관련 ▲"성남시장 재직 시 김문기의 존재를 몰랐다" ▲"경기지사가 되고 기소된 이후 김문기를 알게 됐다" ▲"해외 출장 중 김문기와 골프를 치지 않았다" 등 크게 세 가지 발언으로 기소됐다.

또한 2021년 10월 20일 경기도청에서 열린 ‘2021년도 국토위원회 국정감사’에서 백현동 개발사업 경위를 묻는 질의에 ‘용도변경에서 국토부로부터 압박을 받았다’는 발언을 한 것과 관련 허위사실 공표로 기소됐다. 

2심 재판부는 이재명 대표의 '김문기 몰랐다' 발언에 대해 "피고인의 해당 발언은 단순히 시장 재직 시절 고인을 알았는지 인식을 묻는 질문에 대한 답변으로, 아무런 교유행위를 하지 않았다는 부작위의 암시라고 볼 수 없다"고 판시했다.

이어 '해외 출장 중 김문기와 골프를 치지 않았다'는 발언과 관련해선 "국민의힘 의원이 2021년 12월23일 사진을 게시했는데, 피고인(이 대표)과 김문기, 유동규, 김진욱 등 4명이 보이는데 이 사진은 원본이 아니다"라며 "사진 원본은 4명을 포함해 함께 해외 출장을 간 10명이 앉거나 서서 찍은 사진인데 10명이 한꺼번에 찍은 거라 골프를 함께 쳤다는 증거가 될 수 없고, 원본 일부를 떼낸 것이라서 조작된거라 볼 수 있다"고 했다.

골프 라운딩에서는 통상 4명이 1팀이 이루는데, 10명의 인원 중 4명만 잘라내 마치 함께 라운딩을 간 것처럼 사진을 조작했다는 것이다.

이와 함께 '백현동 발언'과 관련해선 "국토부 협박 발언은 당시 상황을 압축적으로 표현한 것으로, 정치적으로 용도변경 관련 의견표명에 해당한다"고 이 역시 허위사실 공표죄로 처벌할 수 없다고 봤다.

한편, 2심에서 무죄를 선고받은 이 대표는 사법 리스크를 일정 부분 해소하면서 대권가도에 탄력을 받을 전망이다.

He was also indicted for publishing false facts in relation to his statement that he was “pressured by the Ministry of Land, Infrastructure and Transport in changing the use” in response to a question about the circumstances of the Baekhyeon-dong development project at the “2021 National Assembly Land, Infrastructure and Transport Committee State Audit” held at the Gyeonggi Provincial Office on October 20, 2021.

The second trial court ruled that regarding Representative Lee Jae-myung’s statement that he “did not know Kim Moon-ki,” “the defendant’s statement in question was simply a response to a question asking whether he knew the deceased while he was mayor, and cannot be seen as an inaction to suggest that he did not engage in any acts of communication.”

Regarding the statement that "I did not play golf with Kim Moon-ki during my overseas business trip," he said, "A member of the People's Power Party posted a photo on December 23, 2021, and four people including the defendant (Representative Lee), Kim Moon-ki, Yoo Dong-gyu, and Kim Jin-wook are visible, but this photo is not the original." He added, "The original photo is a photo taken of 10 people sitting or standing together on an overseas business trip, including the 4 people. Since the 10 people took the photo at once, it cannot be evidence that they played golf together. It can be seen as a manipulation because it is a part of the original."

Usually, 4 people make up a team in a golf round, but it is said that only 4 out of 10 people were cut out and manipulated to make it seem like they went on a round together.
