필자는 12월 7일 칼럼(윤석열이 윤석열을 위한 난(亂)에 대한 책임은?)에서 ‘탄핵’을 받아야 하는 사유를 7가지 들었다. 12월 7일 오후 5시, 국회에서 김건희 특검 재표결 후 대통령 탄핵소추안 표결에서 국민의힘 의원 3인을 제외한 나머지 105인은 밤 10시가 되도록 본회의장에 나타나지 않았다. 탄핵소추안 부결 후, 국민의 분노는 하늘을 찌르고 있는 상황에서 난(亂)에 동참한 장군들의 고백과 실행과정, 그리고 여러 진술들이 쏟아지면서 국민은 통분을 금하지 않을 수 없었다. 

특히, 의도적으로 표결에 참여하지 않았던 다수의 국민의힘 소속 의원들은 국민으로부터 다량의 비난 문자, 지역 유권자와 언론으로부터의 비난 등이 쇄도하고 있다. 이들 중 윤상현(인천 동구미추홀구을)은 “탄핵 반대해도 1년 지나면 다 찍어주더라”라는 망발을 쏟아낸 것에 진정 국회의원인지 의심이 들 정도였다. 그리고 다른 국민의힘 의원은 대통령의 하야(下野)성 발언을 던지기 시작했다.

이 시점에서 대통령의 하야는 난(亂)을 비롯하여 다른 국정운영 등에 대한 책임을 개인적으로 통감하고 직을 내려놓는다는 것에 이해는 하지만, 다른 한편에선 탄핵 표결에 참여하지 않았던 국민의힘 의원에게 면죄부를 주는 것과 헌법을 무시하는 처사라고 판단된다. 헌법기관인 국회의원이 논리와 근거가 부족한 당론에 따라 개인의 뜻을 저버린 행위는 국민을 기만하는 행위라 본다. 그렇지만 당론과 의원의 의사가 일치했다면 ‘탄핵 반대’에 대한 논리를 구성하고 자신의 뜻을 국민을 상대로 끝까지 관철시켜야 한다. 그런데, 국민이 분노해 있다고 해서 국회의원이 책임 회피성 대통령 하야를 외치는 것은 자신이 진정 국민의 뜻을 이어갈 의사가 없는 것으로 보인다. 

개혁이든 쿠데타든 큰물을 헤쳐 나갈 땐 뚜렷한 명분이 있어야 한다. 특히, 이 난(亂)은 뚜렷한 명분이 없다. 몇몇이 모여서 일으킨 작태에 불과한 것에 헌법기관인 국회의원이 명분을 만들어 주겠다는 행태에 도저히 납득이 안 된다. 하늘이 알면 인간도 곧 알게 된다고 했다. 속속 밝혀지는 난(亂)의 책임자와 실행 과정이 어처구니없으며, 그저 놀랍기만 하다. 국회의원은 이런 전후 사정을 늦게 알게 되었던 몰랐던 탄핵소추안에 대해 소신껏 표결에 임해야 할 것이다. 이는 헌법 제46조 ②항에 명시된 ‘국가이익에 우선하여 양심에 따라 직무를 수행’하는 것과 같다. 그리고 우리 헌법이 명확히 삼권분립을 천명했기 때문에 대통령 하야가 아닌 국회의원의 심판을 우선 받아야 할 것이다. 이것이 민주주의를 수호하는 정도를 걷는 것이며, 더 나아가 세계의 민주주의 모범국가로 거듭날 수 있는 기회가 될 수 있다.

In my column on December 7 (Is Yoon Seok-yeol responsible for the chaos for Yoon Seok-yeol?), I listed seven reasons why he should be impeached. At 5 p.m. on December 7, after the re-vote on the special prosecutor Kim Gun-hee, the remaining 105 members of the People Power Party, excluding the three members, did not show up in the plenary session until 10 p.m. After the impeachment motion was rejected, the public’s anger was sky-high, and as confessions from the generals who participated in the chaos, the execution process, and various statements poured in, the public could not help but feel indignant.

In particular, many People Power Party members who intentionally did not participate in the vote are receiving a flood of criticism from the public, local voters, and the media. Among them, Yoon Sang-hyun (Dong-gu Michuhol-gu, Incheon) made the outrageous remark, “Even if you oppose impeachment, they’ll all vote for you after a year,” to the point where one wonders if he really is a member of the National Assembly. And other People Power Party members began making remarks suggesting that the President should step down.

At this point, it is understandable that the President’s resignation means that he personally feels responsible for the chaos and other state affairs and steps down from his position, but on the other hand, it is an act that gives a free pass to People Power Party members who did not participate in the impeachment vote and ignores the Constitution. I believe that the National Assembly, a constitutional body, is deceiving the public when it abandons its personal will based on a party line that lacks logic and basis. However, if the party line and the member’s will are aligned, it should formulate a logic for “opposing impeachment” and push its own will through to the end against the public. However, when a member of the National Assembly calls for the resignation of a president who is evading responsibility because the people are angry, it seems that he has no intention of truly carrying out the will of the people.

Whether it is reform or a coup, there must be a clear justification when navigating a big water. In particular, this chaos has no clear justification. It is completely incomprehensible that a member of the National Assembly, a constitutional body, is trying to create a justification for something that was merely a conspiracy caused by a few people. They say that if heaven knows, then humans will soon know. The person responsible for the chaos and the process of its execution are being revealed one after another, and it is simply astonishing. Members of the National Assembly should vote with conviction on the impeachment motion that they learned of late or did not know about. This is the same as ‘performing one’s duties according to one’s conscience, prioritizing national interests’ as stated in Article 46, Paragraph 2 of the Constitution. And since our Constitution clearly states the separation of powers, the judgment of the National Assembly, not the resignation of the president, should be given priority. This is a step towards protecting democracy, and it could become an opportunity to further develop into a model democracy for the world.
