필자는 왜 이 사건을 끈질기게 추적해왔나?
필자(브레이크뉴스 발행인)는 이 사건의 초기 과정에서부터 대법 판결 때까지, 사건의 진행과정을 보도해왔다. 이를 종합해서 재판의 중간 과정에 “정명석을 만나러간다”라는 저서(대양미디어 출판사/2023년 9월25일 초판발행)를 발행하기도 했다.
정명석 목사가 법(法)에 의지할 수 있는 마지막 선택사항은 헌법소원이 있을 수 있다. 헌법소원이란, 공권력-법률이 헌법정신에 위배될 경우, 권리를 침해받은 사람이 헌법재판소에 재판을 청구하는 제도이다. 헌법재판소법 제68조 제1항과 제75조 제3항이 근거가 되는 법률조항이다. 법치주의 국가인 우리나라에서 있는 특별한 법률구제 수단이다. 필자는 이 사건의 헌법소원을 조언한다.
그 이유는 간단하다. 대한민국 헌법 제20조는 “모든 국민은 종교의 자유를 가진다”고 돼 있다. 종교의 자유란 헌법이 보장하는 자유이다. 헌법(법률)이 허용하는 범위 안에서 다른 제한이나 간섭을 받지 않고 종교를 믿거나 그를 거부할 수 있는 자유를 말한다. 민주주의 사회를 지탱하는 최 상위(上位) 가치라 할 수 있다.
정명석 목사는 종교 단체의 목사(성직자)이다. 그는 예수가 메시아라고 주장했듯이 그 자신도 메시아라고 주장할 수 있는 자유까지도 부여돼 있다. 그의 설교를 수용하는 교인들이 그를 메시아라고 믿든, 안 믿든, 그 역시 종교자유의 영역에 속한다. 이런 최 상위 가치를 세뇌(洗腦)로 포장, 법원이 징역 17년 형을 판결한 것은 종교자유의 중요한 침해 요소로 여겨진다. 기독교의 자발적인 종교자유 영역인 10의 1조라는 제도도 세뇌(洗腦)라고 하지 않는 이유가 여기에 있다. 정명석 사건 3심까지의 판결은 인간세상의 최상위 가치인 종교자유가 지닌 무한 가치를 훼손한 처사임을 지적한다.
진정한 종교의 자유란, 세뇌(洗腦)라는 하찮은 권리까지를 포괄하는 총체적인 무한자유의 개념이다. 종교의 자유 아래에서 설교를 해온 설교자의 언설을 세뇌(洗腦)로 판결하는 법정 언어는 무식의 극치를 의미한다. 한국의 법정은 이 사건을 통해 무식(無識)함을 드러냈다. 비교하자면, 예수는 사형 당함으로써 예수교회의 부흥을 견인(牽引)했다. 인간에게 가장 혹독한 방법인 사형(死刑)이 그의 목숨을 앗아갔다. 하지만, 그런 고통을 감수한 사랑전파가 기독교의 부흥을 가져왔다.
이와 마찬가지로 장기징역 판결을 받은 정명석 목사는 건강이 허락하는 한, 기존에 해온 대로 ‘옥중목회’를 지속할 것이다. 국가가 보호해주는 확실한 감호(監護)시설에서 신앙생활의 깊이를 더해갈 수도 있다고 판단한다. 그에게 그가 믿어온 하나님은 또 다른 가호가 있을 수 있음을 지적한다.
정명석 목사는 대한민국이 구축해온 종교의 자유 속에서, 거침없이 선교활동을 펴, 오늘날의 기독교복음선교회라는 종교 단체를 발전시켜 놨다. 기독교복음선교회의 월명동 자연성전을 가 보면, 그의 업적이 무언지, 한 눈에 들어온다. 징역 17년 형, 그럼에도, 그가 다시금 용기를 얻어, 투옥 중에라도 최상-무한가치인 종교 자유에 성심껏 복무하기를 빈다. 필자 역시, 그에 관한 무제한 보도가 허용된-언론의 자유-종교의 자유가 만발(滿發)한 대한민국에 살고 있음에 감사한다.

기독교복음선교회측은 1월9일 발표한 입장문의 결론 부분에서 “앞으로 법적 대응을 통한 모든 가능한 조치를 강구할 것이며, 왜곡된 여론을 바로잡고 진실을 알리기 위해 사회적 소통과 언론 홍보를 포함한 모든 노력을 다할 것"이라며 ”포기하지 않고 진정한 승리를 위해 끝까지 최선을 다해 새롭게 도약할 것“이라고 덧붙였다.
