최상목 대통령 권한대행 안이 가장 바르고 옳다. 공수처가 아무리 날뛰어도 합법적이지 않다. 헌재 판단이 나오기 전까지 윤석열 대통령은 내란범이 아니다. 내란 혐의자다. 더구나 그 흉측한 내란 수괴도 아니다. 망나니 춤추듯이 함부로 그러면 못쓴다.

급한 사람 이재명 하나 때문에 온 나라가 이리 소란스러우면 우리 기업들이 어려워진다. 체포 -구속-기소한들 대통령 임기는 어차피 헌재 인용 시각에 맞춰 끝난다. 재판해서 3심까지 어느 세월에 가나, 3심에서 내란이라고 판결한들 대통령직은 반드시 헌재(헌법재판소) 인용만으로 사라질 수 있다. 기각되면 자동 복직하는 것이다.

다만 헌재는 수사권이 없으니 국회가 여야 합의로 윤석열 특검법을 합의하여 의결하기른 바란다. 누가 수사하든 국회가 의결한 특검이 수사하면 정통성을 갖게 되고, 영장도 합법이 되고, 기소도 합법이 된다.  그걸 헌재가 참고하면 된다. 그래서 윤석열 대통령이 죄가 있으면 징역 살고, 없으면 대통령직에 복귀하면 된다.

우리 서로 속이지 말고 사실 그대로만 받아들이자. 있는 죄 덮지 말고, 없는 죄 뒤집어씌우지 말자. 모든 정치 시간은 헌재 인용 시각으로부터 시작된다. 좀 참고 기다려라. 우리 국민 민주주의 지수가 까마득히 멀다. 딱 한 사람,  최상목 대통령 권한대행만 제 정신 차리고 있는 것 같다.

자유주의 공동체가 이 분의 꿈이었다. 중정무사(中正無私), 이 분이 세상을  떠날 때까지 쥐고 있던 신념이었다. 그래서 나도 중정(中正)과 적중(的中)을 쥐고 있다. 이 분은 서울대 법대 교수라고만 아는 분들이 많다. 그렇긴 하지만 전공이 법 경제학이다. 이 분이 학생 시절의 최상목 권한대행에게 법률가가 되지 말고 세상을 위해 경제 전문가가 되라고 권했다는 기사를 어디서 보았다. 박세일 선생이라면 그랬을 것 같아 그 말이 맞다고 나는 생각했다.

Even if he is arrested, detained, and indicted, the president's term will end at the time of the Constitutional Court's acknowledgment. No matter how long it takes until the third trial, even if the third trial rules that he is guilty of sedition, the presidency can be eliminated with just the Constitutional Court's acknowledgment.
