윤석열 대통령의 석방으로 민주당은 거의 패닉상태에 빠진 듯하다. 죽은 자식 불알 만지는 심정인지 무슨 억하심정인지 모르겠으나 검찰총장을 탄핵하겠다고 한다. 내가 보기에는 어이없는 오해에서 벌어지는 일이다.
지난 12.3 비상계엄 이후 몰아친 ‘내란광풍’에서 공수처, 서부지방법원, 검찰, 그리고 헌법재판소가 무슨 공을 세우겠다고 뛰어드는 오합지졸처럼 서로가 경쟁적으로 법을 어기고 탈법과 꼼수를 서슴지 않는 ‘난장판’이 벌어졌다. 나나 유창종 전 서울지방검찰청 검사장은 언젠가 ‘사법영웅’이 출현하여 이 ‘난장판’을 가라앉히는 계기를 마련할 것이라고 말하며, 조용히 사태를 주시하고 있었다.

유창종 선생은 아무래도 검찰이 친정이어서 그런지 검찰에서 사법영웅이 나올 것이라고 했으나, 나는 구속취소 재판을 맡은 지귀연 판사에게 큰 기대를 걸었다. 그리고 구속기간 계산에서 지 판사가 용단을 내려줄 것이 아닌가 예측하였다.
이번 탄핵정국에서 사법의 ‘난장판’을 만든 것은 다름 아닌 한국의 재조(在朝) 법조인들이다. 한국의 사법은 워낙 이런 추태를 벌이는 일이 잦아 한국민의 사법신뢰도는 OECD 37개국 중 항상 제일 밑바닥이다. 나는 평생 이를 바로잡고자 ‘사법개혁’을 주창해온 사람이다. 그러나 이런 추잡한 현실에서도 고귀한 연꽃처럼 피어나, 자신의 성심성의를 다하여 올바른 재판을 실현해온 거룩한 판사들이 그나마 한국 사법의 명맥을 유지시켜 왔다. 나는 지귀연 판사가 바로 그 연꽃 판사의 한 사람이라는 확신을 가졌다. 그리고 탄핵정국에서 야기된 사법의 ‘난장판’이 끝나고 법치의 질서가 회복될 계기가 찾아올 시기가 되었다고도 믿었다. 그래서 그런 예측을 한 것이다.
윤 대통령이 구속취소로 석방이 되자 또 이것이 갖는 의미를 애써 축소하는 사람들이 적지 않다. 제발 정신들을 좀 차렸으면 한다. 왜 모두 그다지도 나무 하나하나에 시선을 꽂은 채 숲 전체를 보지 못하는가? 그 석방은 이제 한국 사회가 법치의 축을 되찾았다는 엄숙한 시그널이다.
과거 박근혜 대통령 탄핵 당시 나는 헌법학자로서 그리고 헌법재판의 전문가로서, 거의 정확한 날짜(1주일의 오차)에 8:0으로 탄핵인용결정이 선고될 것이라는 예측을 한 적이 있다. 최근에 이 사실을 말하니, 지금 물불 가리지 않고 탄핵반대운동을 하는 어느 전직 의원이 분하다는 어조로 나를 비난하였다. 그런데 내가 정확한 예측을 했다고 하여 욕먹을 수는 없지 않는가? 그 역시 자신의 선입견, 이해관계가 빚은 오해의 상(像)을 붙잡고 진실의 태양을 향하여 저주하고 있을 따름이다. 지금 민주당이 보이는 행태와 조금도 다름이 없다.

민주당이 지금 냉철한 자세를 회복하여 사태를 올바르게 내다보지 않으면 계속 헛발질을 하게 된다. 도대체 그 많은 민주당의 국회의원이나 참모들 가운데 윤 대통령의 구속취소가 있을지도 모른다는 생각을 했던 사람은 단 하나도 없단 말인가!
민주당 그리고 주류언론은 하루빨리 ‘내란몰이’ ‘극우몰이’의 자위적 나르시시즘에서, 그리고 그것이 만든 오해의 허상에서 빠져나와야 한다. 젊은 층을 중심으로 새로운 시대를 만들어가는 거대한 변혁의 물결이 지금 한국사회를 관통하여 도도히 흘러가고 있다. 이 현실을 겸손하게 진실로 수용하기를 조언한다.
