브레이크뉴스 임국정 기자 = 여당인 국민의힘의 법률자문위원장을 맡고 있는 주진우 의원이 25일 윤석열 대통령 탄핵심판 결과와 관련해 기각 가능성이 더 커졌다고 예상했다.

주 의원은 이날 SBS 라디오 '김태현의 정치쇼'에 출연해 전날 있었던 헌법재판소의 한덕수 대통령 권한대행(국무총리) 탄핵 기각 결과를 분석하며 이같이 밝혔다.

그는 "(윤 대통령 탄핵이) 기각될 가능성이 구도 보니까 더 높아진 것이, 증거나 이런 것에 절차적 위반이 많으면 증거 자체를 채택 안 하거나 증거의 효력을 부정할 수가 있다"라며 "예를 들어 대통령의 체포 지시가 있었다 없었다 하는 부분도 헌재가 너무 편하게 진행하다 보니까 증인을 너무 적게 불러본 거다. 그런데 그 증인인 곽종근(전 육군 특수전사령관), 홍장원(전 국가정보원 1차장)조차도 진술이 막 번복된다"라고 지적했다.

이어 "엄격한 증명주의, 증거주의에 따를 때 현재 대통령의 체포 지시가 있었다고 볼 증거가 충분하냐 이런 부분에 헌법재판관들의 의견이 엇갈릴 수가 있다"라며 "그런 부분이 이번(한 권한대행 탄핵심판)처럼 각하나 기각이 엇갈리면서 주문은 기각이 나올 수도 있는 상황"이라고 봤다.

'한 총리 탄핵심판 결과를 보니 대통령 탄핵심판 기각의 가능성은 더 높아졌다고 전망하는 거냐'는 진행자의 질문에 주 의원은 "그런 것도 그렇고, 14일에서 하루도 재판을 더 안 열어줄 것처럼 하다가 헌재가 (윤 대통령 탄핵 심판 선고를) 2주나 늦게 잡으니까 '이견이 굉장히 강하게 충돌하고 있구나'"라며 "이건 국민들께서도 다 눈치채셨을 것이라 생각한다"라고 답했다.

주 의원은 이번 한 권한대행 탄핵 기각 결과가 "현재 (헌재의) 5 대 3 (인용 대 기각·각하) 구도를 어느 정도는 정확히 보여줬다"라고 평가했다.

그는 "2명의 재판관이 별개의 의견이 아닌 명확한 각하 의견, 반대 의견으로써 자기 의사를 명확히 한 측면이 있다"라며 "김복형 재판관도 마은혁 (헌법재판관 후보자) 임명하지 않더라도 위법조차도 아니라고 판단한 거다. 기존에 기각 의견을 냈었던 다른 재판관 네 분하고도 굉장히 결이 많이 다른 것"이라고 분석했다.

주 의원은 또 "헌법재판은 완전히 사법 영역은 아니다. 정치적 영역이 있다"라며 "국민을 통합해야 되고, 국론 분열을 막아야 되고 이런 임무도 부여돼 있다 보니까 여론을 살피는 것이 헌법재판에 있어서는 어느 정도 허용된다"라고 했다.

그는 "이재명 (더불어민주당) 대표 선고에서 만약에 당선무효형이 나온 상태에서 대통령 탄핵심판이 이번 주 금요일에도 선고 기일이 잡히지 않는다고 하면, 여론의 흐름이 민주당이 탄핵을 남발해 왔다는 것에 대한 국민적 평가는 높아지고, 또 그것이 이 대표 사법 리스크 때문이구나라는 그림이 보이는 것"이라며 "그 상황하에서 대통령 탄핵심판이 늦춰지면 늦춰질수록 탄핵이 기각 또는 각하될 가능성이 높아지는 것"이라고 말했다.
